These Hosting and Booking Terms (the "Hosting Terms") apply to vacation rental websites hosted by Acorn Pages ("we", "us") and to stays booked through them. They supplement our Terms of Service, which continue to apply; where the two differ about a rental or a stay, these Hosting Terms govern. Part A is for hosts, the owners of a site who list a property and take bookings. Part B is for guests, who book a stay through a host's site. A host accepts Part A by ticking the box in their site's editor before a property takes bookings; a guest accepts Part B by sending a booking request or paying for a stay.
Every stay booked through your site is a contract between you and your guest. We are not a party to it. You decide whether to accept each request, you provide the accommodation, and you alone are responsible for the property, the stay and everything that happens during it. Where your guests pay online, the payment is made to your own Stripe account under Stripe's terms: you are the merchant of record, and refunds, chargebacks and disputes are between you, your guest and Stripe. We keep the platform fee shown when you connect your account (currently 3% of each stay paid online) and hold none of your guests' money.
You set your rates, seasons, fees and discounts, and you are responsible for their accuracy and lawfulness. Before a property can take bookings you must list every lodging, occupancy, sales or similar tax that applies to stays at it, at the rate the law sets, or declare that no such tax is charged. That declaration is yours: you are responsible for knowing which taxes apply to your property and for registering for, collecting, reporting and paying them, and for any penalty, interest or shortfall if you do not. Where a marketplace such as Airbnb or VRBO collects a tax on stays booked there, it does so for those stays only. The tax reports, Schedule E figures and estimates in your site's editor are made from what you enter and what you read in; they are a convenience, not tax advice, and we do not warrant them. Consult a tax professional about your obligations.
You are responsible for every registration, licence, permit, insurance policy, safety measure, accessibility requirement, notice and disclosure that short-term rental, hotel, zoning, consumer, privacy or other law requires of you where the property is, including any limit on the nights it may be rented and any requirement to display a registration number. We may ask you for evidence of them, and may take a booking page offline if we believe a listing is unlawful.
Your calendar on the site is kept in step with the calendars you link from other sites by reading them periodically, and they read yours on their own schedule, so a night can be booked in two places in the gap between reads. You approve each request with that in mind, and you are responsible for honouring or resolving a double booking with your guests. Keep the nights you block and the calendars you link current.
Your house rules, check-in and check-out arrangements, deposits, cancellation terms and refund policy are yours to set, to show on your site and in your messages, and to keep. A guest who cancels, or a stay you cancel, is refunded as your policy and the law require; when you cancel a stay paid online through the site, the full amount is refunded to the guest unless you choose otherwise, and our platform fee is returned with it. Treat guests lawfully and without unlawful discrimination.
A booking gives you a guest's name, email address, phone number and message, and a paid stay the record of its payment. You receive them to provide the stay and for nothing else, you keep them safe, and you honour requests to delete them when the law requires. Our Privacy Policy says what we keep and why.
We provide the booking page, calendar, pricing, payment link, messaging and tax tools as part of the Service, as they are, and the Terms of Service' disclaimers, limitations of liability and indemnity apply to them and to every stay. We are not a travel agent, property manager, insurer or tax adviser. We are not liable for a guest's conduct, for damage to a property, for an injury, for a double booking, for a tax you owe, or for a marketplace reading your calendar late.
We may change these Hosting Terms as the Terms of Service allow. The version you agreed to, and when, is recorded on your account; the current version is always at this address.
Your contract is with the host. Booking a stay through a host's site, whether by sending a request or paying for an approved stay, makes an agreement between you and that host, on the host's house rules, prices, fees, taxes, cancellation terms and refund policy as shown to you. Acorn Pages hosts the site and provides the tools; we are not a party to your stay, we do not own, manage, inspect or insure the property, and we are not responsible for it, for the host, or for any loss or injury during your stay.
Payment. If you pay online, you pay the host through Stripe, into the host's own account, under Stripe's terms; the card details go to Stripe, not to us or the host. The price you see when you book is the price you pay, inclusive of the fees and taxes listed. Refunds and disputes are between you and the host; their refund policy applies, and when a host cancels a stay paid online through the site, you are refunded in full.
Your details. The name, email address, phone number and message you give go to the host, who uses them to provide your stay, and are kept by us to run the booking, as our Privacy Policy describes. We email you only about your booking.
Accuracy. Give accurate details, including the number of guests, and keep to the host's rules. The host decides whether to accept a request; nothing is reserved until they do.
